Contempt of court

Delhi High Court Orders Narinder Batra to Stop Functioning as IOA Chief

June 24, 2022 by www.news18.com

Veteran sports administrator Narinder Batra was on Friday ordered to stop functioning as Indian Olympic Association (IOA) president by the Delhi High Court “in a contempt proceeding”, a month after it asked him to relinquish the top job. A vacation bench of Justice Dinesh Sharma passed the order on a contempt petition filed by Olympian and hockey World Cup winner Aslam Sher Khan. “The court ordered that Mr. Narinder Batra should stop from functioning as IOA president with immediate effect,” advocate Vanshdeep Dalmia, who appeared on behalf of Khan, told PTI. “It was a contempt proceeding as Mr. Batra was continuing to attend meeting as IOA president despite an earlier order of this court. “The court also said Mr. Anil Khanna, senior vice-president, will be the acting president of the IOA,” he added. On May 25, Batra was removed as IOA chief after the Delhi High Court struck down the post of ‘life member’ in Hockey India, courtesy which he had contested and won the apex body … [Read more...] about Delhi High Court Orders Narinder Batra to Stop Functioning as IOA Chief

GPF recoveries: Andhra Pradesh High Court asks petitioner to file detailed affidavit

June 29, 2022 by www.thehindu.com

A Division Bench of the Andhra Pradesh High Court led by Chief Justice Prashant Kumar Mishra and comprising Justice D.V.S.S. Somayajulu on Wednesday took note of the allegation by A.P. Gazetted Officers’ Joint Action Committee chairman K.V. Krishnaiah that the government was recovering excess Interim Relief (IR) from the GPF accounts of some government employees in violation of a previous order of the court, and directed him to file an affidavit explaining how it was being done, in two weeks. Mr. Krishnaiah’s argument was that the High Court had, in its order dated February 1, directed the State not to make recoveries from the salaries of employees while imposing a stay on the G.O.s through which the Revised Pay Scales 2022, had been notified as per the recommendations of the 11th Pay Revision Commission. He contended in a rejoinder that excess interim relief drawn by employees should be adjusted to future dearness allowances arrears, but it is being violated. Further, he claimed … [Read more...] about GPF recoveries: Andhra Pradesh High Court asks petitioner to file detailed affidavit

Lokman gets show-cause notice for contempt over retort during Zahid’s graft trial

June 30, 2022 by www.thestar.com.my

KUALA LUMPUR: Former Umno supreme council member Datuk Lokman Noor Adam (pic) has been issued with a show-cause notice for contempt by the High Court for verbally abusing a policeman at the corruption trial of Datuk Seri Dr Ahmad Zahid Hamidi. This followed a complaint by the prosecution that Lokman was ticked off by a policeman who told him not to "play" with his mobile phone while sitting in open court. Deputy Public Prosecutor Datuk Raja Rozela Raja Toran said Lokman responded by calling the policeman "stupid". "This is rude and insolent behaviour. I move the court to cite him (Lokman) for contempt as the incident happened during the proceedings," Raja Rozela said here on Thursday (June 30). When asked by Justice Collin Lawrence Sequerah if he had anything to say about the incident, Lokman explained that he was not calling the policeman stupid but "the law is stupid". He said it was unfair that those in court were able to use their laptops but not their mobile phones. … [Read more...] about Lokman gets show-cause notice for contempt over retort during Zahid’s graft trial

South Africa’s Top Court Rejects Former President Zuma’s Bid to Overturn Jail Sentence

September 17, 2021 by www.news18.com

South Africa's top court on Friday rejected former president Jacob Zuma's application to rescind his 15-month-jail sentence for contempt of court. Zuma handed himself over in July after the Constitutional Court found him to be in contempt of court for repeatedly refusing to return to the Commission of Inquiry into State Capture, where several witnesses have given details of his alleged role in a number of issues relating to the looting of state departments and parastatal organisations. In a majority judgement of the Constitutional Court, Judge Sisi Khampepe dismissed 79-year-old Zuma's application of rescission with costs. Commenting on Zuma's conduct, Khampepe said that he had wilfully refused to participate in litigation and then reopened the case when it suited him. The majority emphatically reject any suggestion that litigants can be allowed to butcher of their own will judicial process which in all respects has been carried out with the utmost degree of regularity, only later … [Read more...] about South Africa’s Top Court Rejects Former President Zuma’s Bid to Overturn Jail Sentence

GOP state rep. files to hold Illinois gov. in contempt over COVID-19 orders

August 5, 2020 by www.newsweek.com

A Republican Illinois state representative has filed a legal petition to hold the state's Democratic Governor J.B. Pritzker in contempt for issuing new executive orders intended to mitigate the spread of COVID-19. Rep. Darren Bailey filed the petition Wednesday, contending that three new orders issued late last month by Pritzker violated a July 2 ruling from Clay County Circuit Court Judge Michael McHaney, who ruled that the governor overstepped his authority by issuing similar orders beyond 30 days in April. The petition argues that Pritzker's orders, which continue earlier measures and establish health guidelines for the transfer of prisoners and for school reopenings, are "contemptuous acts which are calculated to embarrass, hinder, or obstruct" the Clay county court. The petition seeks to force Pritzker to rescind his new orders or "be placed in the temporary custody of Clay County Jail until he purges himself by rescinding" the orders. "All I can say is the rulings out of … [Read more...] about GOP state rep. files to hold Illinois gov. in contempt over COVID-19 orders

PM & Prez Have to Visit Bengaluru Often for Civic Agencies to Do Their Duty? Asks Karnataka HC

June 24, 2022 by www.news18.com

The Karnataka High Court has wondered whether the President and Prime Minister should often visit the city and travel on different roads for civic agencies to do their job. The HC said this in reference to reports that the city civic body, Bruhat Bengaluru Mahanagara Palike (BBMP), spent Rs 23 crore to repair roads in the city for the Prime Minister's recent visit. The chiding came during the hearing of a contempt petition against Bangalore Development Authority (BDA) and Bangalore Water Supply and Sewerage Board (BWSSB) officers. Manjula P and Sharadamma P had approached the HC seeking restoration of water and sewerage line connection to two of their housing sites in Visvesvaraya Layout. The connections were sanctioned but not laid. On October 21, 2020, a single-judge bench of the HC ordered the civic agencies to restore the connection to the two sites within two months and disposed of the case. The two women approached the HC a year later with a contempt petition against the … [Read more...] about PM & Prez Have to Visit Bengaluru Often for Civic Agencies to Do Their Duty? Steve Bannon asks DOJ why Mark Meadows not prosecuted over Jan. 6 probe

June 28, 2022 by www.newsweek.com

Steve Bannon is seeking the Department of Justice (DOJ) to hand over records explaining why former White House Chief of Staff Mark Meadows and ex-Deputy Chief of Staff Dan Scavino escaped prosecution for not fully complying with their congressional subpoenas, whereas he was charged over similar offenses. Bannon, a former White House adviser, was the first of Donald Trump 's inner circle to face criminal charges for refusing to cooperate with the subpoena issued to him by the House Select Committee investigating the January 6 attack on the U.S. Capitol. Bannon is due to stand trial on charges of contempt of Congress and refusal to produce documents to the select committee after his argument that he couldn't comply because of executive privilege was thrown out. Peter Navarro, a White House trade adviser under the former president, was also charged with contempt for refusing to comply with the subpoena. However, the DOJ decided not to press charges against Meadows and … [Read more...] about Steve Bannon asks DOJ why Mark Meadows not prosecuted over Jan. 6 probe

‘Casual’ Reply Lands Punjab DSP in Trouble With SC, Home Secretary Asked to Explain

October 11, 2018 by www.news18.com

New Delhi: A Deputy Superintendent of Police (DSP) in Punjab has invited trouble for the state's Home Secretary in the Supreme Court. Called upon by the top court to explain the remission policy in Punjab, the DSP delegated this job to his principal private secretary (PPS). The PPS filed a "casual" affidavit in the court and a bench headed by Justice NV Ramana has now summoned the Home Secretary to show up and explain. The bench expressed "shock" at the manner in which the DSP chose to respond through a junior officer, who appeared even more casual. The bench remarked that the DSP thought only this much of the order by the highest court of the land that he decided to let his PPS file an incomplete and perfunctory affidavit. "It is unfortunate that a PPS, Deputy Superintendent of Police filed a casual affidavit, without explaining the question framed by this court," said the court. It added that although the court has an option of issuing notice of contempt against the DSP … [Read more...] about ‘Casual’ Reply Lands Punjab DSP in Trouble With SC, Home Secretary Asked to Explain
