A bill designed to better protect residents of mobile home parks won state House approval Monday on a 41-23 vote.House Bill 1309 next heads to the state Senate.Such bills die year after year in the Senate under majority Republicans, who opposed the measures as unduly burdensome to businesses.Now Democrats are in charge. Pete Lee, D-Colorado Springs, and Senate Majority Leader Steve Fenberg, D-Boulder, will carry the bill in the Senate.Operators of mobile home communities say it would add another layer of bureaucracy and unfairly pressure park owners who act in good faith.Its author, state Rep. Edie Hooton, D-Boulder, said she has seven mobile home parks in her district and about 20 countywide. Scott Tipton walked the middle ground July 24 while Republicans and Democrats clashed during a congressional hearing on whether coal should remain a major source of electrical generation.Democrats on the House Natural Resources subcommittee on energy and mineral resources called coal an environmental and health hazard. But Republicans said new and cleaner coal technologies offer economic benefits that make continued mining worthwhile.“It’s not a push back and forth in terms of energy or carbon products,” said Tipton, a Cortez Republican representing western and southern Colorado. “I think we have the capacity to do both.”Colorado was the nation’s 13th largest producer of coal in 2016, the U.S. Energy Information Administration says. Tenth Circuit Hears Arguments in Colorado Renewable Energy Standard Case
On Wednesday, January 21, the Tenth Circuit Court of Appeals heard arguments in a case challenging the constitutionality of Colorado’s Renewable Energy Standard The case was originally filed in 2011 and this latest appeal comes after the group challenging the constitutionality of the 30% renewable energy mandate lost on a motion for summary judgment in U.S. District Court for the District of Colorado.The arguments today focused on whether the negative implications of the Commerce Clause (the Dormant Commerce Clause) prevent the state of Colorado from requiring utilities to generate 30% of the electricity they sell in Colorado from renewable sources by 2020. The three-judge panel asked questions seeking to understand which formulations of the various Dormant Commerce Clause tests they should apply to reach a decision in this case. Colorado Appeals Court Rejects Lone Pine Order in Fracking Case
In a decision that may make it easier for certain plaintiffs to maintain a toxic tort case in Colorado, a Colorado appellate court ruled that a trial court could not order a small number of plaintiffs in a toxic tort case to present prima facie evidence before discovery begins in support of their claims of exposure due to hydraulic fracturing (or “fracking”) operations.
