A bench headed by Chief Justice Ranjan Gogoi said it was not convinced with the grounds of the CBI on the delay in filing the appeal. The CBI appeal was filed in February 2018, twelve years after the Delhi High Court discharged all accused including Europe-based industrialists Hinduja brothers in the Rs 64 crore Bofors pay-off case. The Attorney General General K K Venugopal had advised against filing an appeal after a 12 year delay. “It could be dismissed on grounds of delay and could well prejudice its stand even as a respondent in the appeals already pending (Ajay Agrawal’s petition). The Delhi High Court, on Monday, came down heavily on a Trial Court Judge for rushing through a trial involving allegations of serious offences like murder and unnatural sex with a 14-year-old boy. Noting that the Additional Sessions Judge (ASJ) had allowed examination of “disproportionately” large number of prosecution witnesses on a single day, the Bench comprising Justice S. Muralidhar and Justice I.S. Mehta observed, “The Court finds merit in the contention of counsel for the Appellants that grave prejudice was caused to the accused by the above ‘super-fast’ track procedure adopted by the learned trial Judge. The Court is unable to appreciate why the learned trial Judge considered it necessary to rush through the prosecution evidence in a case of this nature and how she failed to realise that it would result in a grave miscarriage of justice. The incident took place in the back garden of the child's home in the municipality of Camocim, in the north-eastern Brazilian state of Ceara.According to the Daily Mail, neighbors witnessed the incident after they heard the cries of the baby and went to locate it. The mother's brother allegedly followed a trail of blood to the burial place where a pig and a dog were surrounding the corpse. The 24-year-old mother was later arrested by local police for burying her newborn daughter.
