· August 8, 2018 ·

Aug 08, 1:43 PM EDT Newsletter Signup BusinessTechnologyWorldNationalMedia & CultureOpinionSportsLuxury World By Julian Kossoff 08/08/18 AT 1:05 PM Italian police on Wednesday announced the arrest of 11 people for intentionally breaking victims' bones in order to cash in on insurance payouts.Palermo gang members preyed on the vulnerable and showed particular cruelty in the methods they used to break their victims' limbs, such as hurling bodybuilding weights before staging fake road crashes. Sandra the Orangutan Still Awaiting Freedom Two-Years After Court Ruled She Had Legal Rights

· October 3, 2016 ·

In 2014, an Argentine court handed down a ruling that found an orangutan held in captivity at a zoo in Buenos Aires was entitled to certain legal rights as a “non-human person.”  Now, as we come up on nearly two-years since the court handed down this landmark ruling, a new report indicates things have not improved much for Sandra the orangutan.  She reportedly remains locked in a cage at the now-closed Palermo Zoo as the debate continues about what to do with her.The Daily Mail provides more on Sandra’s back story in a recent article that explains how back in 2014 a local animal rights group filed a habeas corpus writ on Sandra’s behalf, arguing “a great ape has rights, including freedom and avoiding suffering from being in captivity.”  A judge agreed, finding Sandra is “legally not an animal but a ‘non-human person,’” according to the report.Earlier this year, another court found Sandra … [Read more...] about Sandra the Orangutan Still Awaiting Freedom Two-Years After Court Ruled She Had Legal Rights

Part II – The Debate over the Parthenon Sculptures: Cultural Assets

· April 6, 2016 ·

Among disputes over removed cultural objects, perhaps few are better known than that concerning what were formerly known as the Elgin Marbles, which even the British Museum now prefers to call the Parthenon sculptures. It is important to note at the outset, however, that even though the Parthenon sculptures were removed during this long age of plunder, were not actually plundered. They were removed with the apparent permission of the government that had ruled the territory for four centuries. The source of the conflict over the sculptures is twofold – (1) Ottoman rule of the territory of modern Greece was in its final decades, and the movement in favor of Greek independence was on the rise (Greece would attain independence in 1832); and (2) the Parthenon, which even at the time had long been recognized as one of the finest examples of classical architecture and sculpture, became an important symbol of Greek independence and nationalism. It is timely to consider the Parthenon … [Read more...] about Part II – The Debate over the Parthenon Sculptures: Cultural Assets

Statute Of Limitations in a New Jersey Workers’ Compensation “Occupational Disease” Claim

· January 18, 2017 ·

Generally, petitions filed by injured workers for occupational disease claims are barred if they are not filed within two years of the date the injured worker discovered the nature of the disability and it relationship to employment. This is addressed in the workers’ compensation law under N.J.S.A. 34:15-34.Unlike an accident, which has a specific date, the precise onset of an occupational disease may be hard to determine. In Earl v. Johnson and Johnson, the court recognized that the period of time for filing an occupational disease claim does not run until two years after the date the injured worker knew the “nature of the occupational disability and its relationship to employment.” What the court meant by that statement has been the subject of many court appeals. In the Earl v. Johnson and Johnson case the court defined the two year statute of limitations as beginning to run when the worker has “knowledge of the most notable characteristics of the disease, … [Read more...] about Statute Of Limitations in a New Jersey Workers’ Compensation “Occupational Disease” Claim
