Recent Decisions Clarify (Un)Enforceability of Class Action Waivers in Employment Agreements
The Court then addressed the enforceability of a contract as a whole. Though Poublon argued that a contract with two illegal or unconscionable provisions should be rendered void in its entirety, the Court held that the two unenforceable provisions could be severed from the rest of the agreement. Because the provisions at issue were “collateral to the main purpose of the contract, which is to require arbitration of disputes,” the provisions could be removed or limited without affecting the remainder of the agreement.
