India ratifies U.N. Convention against Corruption
India on Thursday ratified the United Nations Convention against Corruption — a politically correct move that ought to take some heat off a government battling serious corruption charges and seen as unwilling to crackdown on black money stashed away abroad. Indeed, in recent days a question often asked was why India had not ratified the Convention when asset recovery is stated explicitly as a fundamental principle of the Convention. Besides, member-countries are bound by the Convention to render mutual legal assistance towards prosecution of offenders as well in tracing, freezing, and confiscating the proceeds of corruption. The Prime Minister's explanation for the delay was that the ratification had been under active consideration since September 2010 and a Group of Ministers was deputed to oversee the process. The Communist Party of India (Marxist) said on Thursday that while there may be questions on the nature of the verdict in the Ayodhya case, the judgment needed to be fully studied. In the country's secular democratic system, the judicial process, which included recourse to the Supreme Court, should be the only way to resolve the issue, the party's Polit Bureau said in a statement. It appealed to the people to maintain peace and communal harmony and not fall prey to provocation. Communist Party of India national secretary D. Raja said the split verdict showed that there were complicated issues and the judgment needed to be studied in detail. If any party felt aggrieved, legal course of appeal was available. But at the same time, he cautioned that there should be no public demonstration by taking to the streets either in joy or sorrow. Muslim groups on Thursday reacted with disappointment to the dismissal of the Sunni Central Waqf Board (SCWB) suit and the three-way division of disputed land ordered by the Allahabad High Court in the Ayodhya title suits. SCWB lawyer Zafaryab Jilani said the Board, the main litigant on behalf of Muslims, will appeal against the decision in the Supreme Court: “The High Court's formula of one-third land is not acceptable to the Waqf Board and it will go to the Supreme Court.” Yusuf Muchhala, convener of the legal cell of the All-India Muslim Personal Law Board (AIMPLB), said the SCWB's suit was dismissed for being time-barred — a technical ground.
