Let Creche Facility Within Court Premises Be Fully Functional By March: SC

The Supreme Court on Thursday finally disposed off a writ petition filed by Advocate-on-Record Anindita Pujari challenging the constitutionality of a circular dated June 28, 2015, issued by the apex court to announce the establishment of a creche facility in the court complex. In addition, a recruitment notice dated June 10, 2015, inviting applications for the post of in-charge and helpers at the child care centre was also sought to be quashed.The grievance of the petitioner arose from the impugned circular restricting the use of the daycare facility to the children between the ages of 6 months and 2 years. It was the contented that such a condition is arbitrary and violative of Articles 14, 19(1)(g) and 21 of the Constitution. Breaking: SC Bats For Mediation In Ramjanmabhoomi-Babri Dispute, To Decide On March 6 [Read The Order]

By: Live Law News Network 26 Feb 2019 6:36 AM GMT The hearing in the Ayodhya-Babri Masjid land dispute case before the Constitution Bench of the Supreme Court could not commence in view of the disagreement between the parties over the veracity of translation of records. The Court also suggested that parties explore the option of mediated settlement. However, the Hindu parties represented by Senior Counsel C S Vaidyanathan and Ranjit Kumar were not open to the idea of mediation. The Muslim groups represented by Senior Advocate Rajeev Dhawan expressed their willingness for mediation, if the Court directed so. The Court will pass orders on next Tuesday on whether the issue should be referred to a Court appointed mediator. The hearing was adjourned for six weeks to enable the parties to examine the translations of records prepared by the UP Government. Delhi HC Acquits Peepli Live Director Mahmood Farooqui In Rape Case [Read Judgment & Written Submissions For The Victim]

The Delhi High Court through Justice Ashutosh Kumar today acquitted popular Hindi film Peepli Live’s co-director Mahmood Farooqui from the charges of raping a US research scholar.In a nutshell, the allegation against Farooqui (accused) was that he committed rape u/s 375(d) read with Explanation 2 of the Indian Penal Code, 1860 on the prosecutrix which is punishable with minimum seven years and can punish up to life imprisonment. Sec 375(d) terms application of mouth to genitals of a woman as rape and Explanation 2 defines consent to mean unequivocal voluntary agreement including gestures or any form of verbal or non-verbal communication showing willingness to participate in the specific sexual act.The trial court awarded Farooqui a seven year jail term for sexually abusing the research scholar from Columbia University. One year since Nirbhaya case: Verdict on appeal likely in January

Almost one year after the horrific gangrape of a young paramedic student who was not only raped but brutally assaulted by six men in a moving private bus which shook the country, the Delhi High Court which has been hearing appeals of the four accused and arguments on the death sentence on a daily basis in the sensational case, will pronounce its verdict, most likely in January.According to M.L. Sharma, defense counsel of two of the accused Mukesh and Pawan Gupta, they have been arguing and expecting the verdict to be pronounced in the second week of January. The lawyer said he will try to complete his arguments next week following which the holidays for the court will begin, and then he will have to give fact findings, Supreme Court’s judgments in related cases and conclude it.
