ENERGY AND CLIMATE DEBATEAs Congress wrapped up the first session of the 113th Congress, the House and Senate came together to finalize several pieces of legislation, and policymakers prepared the way for changes to come in 2014.After the House passed the bipartisan budget deal week before last, the Senate sent the measure December 18 to President Obama for his signature. Senate Appropriations Chair Barbara Mikulski (D-MD) and House Appropriations Chair Hal Rogers (R-KY) have begun discussions and will be working through the new year to craft a 12-bill omnibus package that Congress will address when it returns in January. The House is expected to consider the measure by January 10 and the Senate is expected to take up the bill by January 13.The Senate also sent the National Defense Authorization Act to the president’s desk at the end of the week. 21st Century Cures Remains Top Bi-Partisan Priority for 2015: House Energy and Commerce Committee Chairman Fred Upton (R-MI) reiterated his intent to push for a bi-partisan 21st Century Cures Initiative bill in early 2015. Rep. Upton recently remarked that the bill(s) would be on the House floor for a vote before Memorial Day and on the President’s desk by the end of next year. Upton’s timeline includes outreach to the Senate in December and a discussion draft introduced as early as January in the new Congress. Developments impacting high-frequency traders dominated news in financial services last week. The Securities and Exchange Commission proposed amendments to an existing rule that would subject many proprietary trading firms to oversight by the Financial Industry Regulatory Authority for the first time, while both FINRA and the Futures Industry Association issued guidance on best practices for automated trading systems and algorithms. Unrelated, a study by the NY Federal Reserve Bank raised some red flags regarding central clearing. Takeaway: Although the financial product or service portion of the covered business method test is ordinarily addressed before the technological invention exclusion, because the technological invention exclusion is dispositive, that sequence is not required.In its Decision, the Board did not institute covered business method patent review of any challenged claim of the ‘246 patent. The Board reached this conclusion because it was not persuaded that ‘246 patent qualifies as a “covered business method patent” under § 18(d)(1) of the AIA.Petitioner had challenged claims 1-9, 11-14, 16-19, 21, 23-32, 34, 35, 37-45, 51-56, 58, 60, 62-67, and 69-73 of the ‘246 patent, as being directed to subject matter that is not patent-eligible under 35 U.S.C. § 101.
