KUCHING 23 Mei – Kerajaan negeri di bawah kepemimpinan Barisan Nasional (BN) sentiasa serius dalam usaha mendapatkan kembali hak keistimewaan rakyat negeri ini yang termaktub dalam Perjanjian Malaysia 1963 (MA-63) sebelum Pilihan Raya Umum Ke-14 (PRU-14). SHARIFAH HASIDAH Sehubungan itu, Menteri Muda di Pejabat Ketua Menteri, Sharifah Hasidah Sayeed Aman Ghazali menafikan dakwaan yang mengatakan kerajaan negeri tidak berbuat apa-apa dan tidak mencapai kejayaan berhubung tuntutan tersebut. Discussion On Maintainability Of Second Appeal Beyond Substantial Question Of Law
There is nothing to suggest that the judges are infallible on law or facts. In such circumstances, prescribing that a second appeal would not be maintainable on the question of fact and even on the question of law would not be in the interest of general public. But the Section-100 CPC seems to restrict the appellate avenue so far as second appeal is concerned. It provides opportunity of second appeal only on substantial question of law. This definitely is different from a question of law as the word “substantial” restricts the nature of questions of law. There may be two situations in which a litigant may prefer a second appeal. First, when both the courts subordinate to Hon’ble High Court give concurrent findings. In this situation, one may say that concurrent findings returned by two courts should be given some weightage and therefore the same should not be open for challenge in a second appeal. ENERGY AND CLIMATE DEBATEWhen the President outlined his Climate Action Plan on June 25, he stressed the importance of federal leadership on emissions reduction efforts. A little over five months later, he signed a presidential memorandum directing the federal government to obtain 20 percent of its electricity from renewable energy by 2020. The December 5 directive creates an action item for the Climate Action Plan and builds upon the 2009 Executive Order 13514, Federal Leadership in Environmental, Energy, and Economic Performance. ENERGY AND CLIMATE DEBATEThe House and Senate chambers, quiet for over a month, resumed regular business today. ML Strategies has produced a post-Labor Day outlook. Congress has several issues to address now that it is back in session including the appropriations process, the debt ceiling, the extenders package, and the grand bargain. Energy and environment issues may crop up as riders to these topics, such as the Keystone XL pipeline and the Renewable Fuel Standard. The nine major energy issues of note are Shaheen-Portman, the National Helium Reserve, the consideration of the proposed liquefied natural gas export terminals, the Keystone XL pipeline, the future of the Renewable Fuel Standard, the Interior Department’s fracking rule, President Obama’s climate action strategy, Environmental Protection Agency regulations, and the President’s Power Africa initiative. ENERGY AND CLIMATE DEBATEThis past week, Congress was focused on reviewing the president’s proposed Fiscal Year 2014 budget and nominees for several cabinet positions, and we also saw the introduction of the Shaheen-Portman energy efficiency bill that many feel could be enacted this congress. On Wednesday of this week, Senators Coons and Moran are expected to introduce another bill that many believe could be enacted in the 113th Congress – the Master Limited Partnership Parity Act. Sens. Chris Coons and Jerry Moran will be joined by Sens. Stabenow (D-MI) and Murkowski (R-AK). The bill will also be introduced in the House of Representatives by Reps. Ted Poe (R-TX), Mike Thompson (D-CA), Peter Welch (D-VT), and Chris Gibson (R-NY). Also this week, the full House is scheduled to consider a bill, H.R. 527, the Responsible Helium Administration and Stewardship Act, which would privative helium reserves currently under control of the federal government.
