The Thorny Problem of Patentable Eligible Subject Matter: Part 10 of a 10-Part Series: Japan

Patentable Subject Matter in Japan The Japanese Patent Act (Act) contains two provisions regarding patent eligible subject matter. The first provision is found in Article 2(1) of the Act which states that an “invention” must be a “highly advanced creation of technical ideas utilizing the laws of nature”. Specifically, an invention must be a “statutory” invention to be patentable. A list of “non-statutory” inventions is provided in section 1.1 of the Examination Guidelines of the Japanese Patent Office (Guidelines). Energy and Environmental Law Update – March 10, 2014

ENERGY AND CLIMATE DEBATEThough we shared with you our analysis of the energy and environment portions of President Obama’s fiscal year 2015 budget request last week, we wanted to highlight a few additional sections in this week’s report as well. Most proposals in the budget request, released March 4, are holdovers from last year, though the administration included several new energy provisions. The budget request cuts $48.8 billion in fossil fuel tax breaks, and offers new incentives for alternative fuel and energy efficiency projects. The president’s budget request calls for a $1 billion climate resilience fund, which the president announced last month to help coastal areas prepare for severe weather events. The funding, spread across multiple agencies, would increase research and planning efforts on a wide variety of climate impacts. Energy and Climate DebateWith Congress in full swing, the White House preparing for the State of the Union address, and new legislative and executive leaders taking their places in Washington, energy issues continue to garner significant national attention.Senator Lisa Murkowski (R-AK), ranking member of the Senate Energy and Natural Resources Committee, released a broad, 121-page, energy blueprint February 4 that she hopes will provide the foundation for bipartisan energy legislation this Congress.The document, Energy 20/20: A Vision for America’s Energy Future, makes roughly 200 policy recommendations that address nearly all of the major energy issues that have eluded consensus for years. Form 10-Q Koans

Many companies have filed or are about to file their Form 10-Qs for their first quarter.  Thus, it seems an opportune time to present the following koans:Part IV, Item 15 of Form 10-K instructs the registrant to “List the following documents filed as a part of the report . . . Those exhibits required by Item 601 . . .” while Part II, Item 6 of Form 10-Q adjures “Furnish the exhibits required by Item 601″, is there any significance of filing versus furnishing in this context?General Instruction F(2) of Form 10-Q intones “Information presented in satisfaction of the requirements of this form other than those of Items 1, 2 and 3 of Part I shall be deemed filed for the purpose of Section 18 of the [Securities Exchange] Act . . .”.  Does this mean information furnished pursuant to Part II, Item 6 is deemed filed?  If so, why not simply say so?Item 601(b)(2) requires the filing of any “material plan of … [Read more...] about Form 10-Q Koans
