The collegium comprising comprising Chief Justice of India Ranjan Gogoi, Justice MB Lokur and Justice AK Sikri resolved, “We have carefully scrutinized the material placed on record including the reasons recorded in the file seeking reconsideration of the proposal for elevation of Shri Amit Negi. Grounds on which reconsideration of the above proposal has been sought have already been considered by Collegium while recommending the name of Shri Amit Negi on 30th August, 2016. The ruling was delivered by a Division Bench of Chief Justice Dinesh Maheshwari and Justice R Devdas, setting aside the general directions issued by a Single Judge that borrowers have the right to be heard in proceedings under Section 14. The matter pertained Section 14 proceedings initiated by banks against few tenants, who were possessing the secured assets on lease. Challenging the SARFAESI proceedings initiated against them, they approached the High Court. The Single Judge disposed of the writ petition, directing them to approach the DRT against the proceedings within two weeks under Section 17(4A) of the Act. While considering a petition seeking to restrict entry of non-Hindus in Sabarimala temple, the High Court of Kerala orally observed that Sabarimala belonged to all and not just Hindus. The petition filed by T G Mohandas, Convenor of BJP State Intellectual Cell, contended that non-Hindus and non-idol worshippers cannot be permitted entry on the basis of SC judgment in Indian Young Lawyers’ Association case. The Division Bench of Justice P R Ramachandra Menon and Justice Devan Ramachandran criticised the tone and tenor of the petition. The Supreme Court Collegium has recommended his appointment by a resolution dated 12th October 2018 While making the recommendation , the collegium comprising Chief Justice of India Ranjan Gogoi, Justice MB Lokur and Justice Kurian Joseph pointed out that the office of the Chief Justice of Bombay High Court has been lying vacant for quite some time, since the retirement of Justice Manjula Chellur in December last year. “Mr. Justice N.H. Patil is the senior-most Judge from Bombay High Court and at present is functioning as Acting Chief Justice of that High Court. The petition also requests for information about the contract given to Reliance by Dassault. The petition terms the allegations against the deal as “frivolous”, and states that “critics in the opposition parties have adopted a very ignominious and profligate way even to criticise the Prime Minister”.
